Gov Shutdown & BK Court

2013-10-09Federal courts will continue to hear and decide without interruption even if the US government shuts down on Tuesday morning as a result of congressional gridlock.

Federal courthouses will remain open under the terms of the Anti-Deficiency Act, the federal law that calls for “essential” work to continue in the event that federal funding is frozen.  Most judicial services are considered essential; judges would keep working, legal filings would still be processed and federal defenders would continue to be assigned to indigent defendants.

However, while judges continue to hear cases, the Justice Department said it would ask to postpone appearances in civil and bankruptcy cases as long as it did not compromise the safety of human life or the protection of property under the terms of the Anti-Deficiency Act.

The chief judge in each district will have broad latitude to determine which services and staff members were “essential” and which could be put on hold for the duration of the shutdown.  Each court is going to be different.*

The most recent posted statement from the United States Courts states:

The Judiciary will remain open for business through October 17, 2013. When no funding mechanism was in place on October 1, 2013, the Judiciary projected that fee income and no-year appropriated funds would enable court operations to continue for ten business days. The Judiciary has severely restricted spending during that period so that limited additional funding now exists. Spending rates and fund balances will continue to be monitored closely in hope that adequate funds may be available to allow courts to operate through the end of the work week – October 18.

The top 10 states for Chapter 7 Discharges comprise 54.7% of all discharges year-to-date.  Leading the pack is California with 15% of the total Discharges and over twice as many as the runner-up, Florida.

July 2013 Newsletter – Letter from Ann Frank-Shantz

2014-ANN APPROVED PHOTO OF ANNMinneapolis, MN – Can you believe that we’re already in the 3rd quarter of 2013?! The Holiday season seems like it was just yesterday and I was in Houston, visiting our corporate office, cheering on the Minnesota Vikings as they beat Houston!

In February, Sherry Merritt (Client Services) and I attended NADA Sherry and Larry(National Auto Dealers Association) Conference in Orlando, Florida.  This conference is unique as it provides a platform for the entire automotive industry to come together.  In addition to over 1,900 dealerships present, there were hundreds of allied industries there.  We had a great time with some of our existing clients and met a few new ones too!  Our Sherry Merritt is pictured here with Larry Stiver of VIP Marketing, Inc at NADA2013!

graph exMarch brought us a milestone in the social media venue as our Twitter account (@bebdata) reached 300 followed and we have over 300 views on our Facebook page.  Thank you!

In April we received our first Graphic Excellence Award (GEA) for our 2012 Interactive Holiday Card!  Presented by the Printing Industries of the Gulf Coast, we are excited to be recognized by this prestigious organization.  May brought us another milestone in the social media arena, as our YouTube videos were viewed over 500 times, spanning 10 countries!  We also launched our BEBdata LinkedIn page, so be sure to follow us as we blog weekly BK statistics along with other industry news.

DMA 2013In the next six months, we’ll attend the ABA Marketing Conference in San Antonio, TX (September) and are looking forward to the big DMA show in Chicago, Illinois in October.

Chapter 7 Filings Up

Chapter 7 filings have gone down by 7.5% during the first 28-weeks of 2013 compared to the same timeframe in 2012 from 418,323 to 387,095.  The drop between 2012 & 2011 shows an 11.8% decrease in filings for a total downward trend of 18% over the past two years.

Chapter 7 Discharges Decrease by 21%

Chapter 7 discharges decreased by 21% in June 2013 when compared to the same four-week period of 2012.  California lead the way with a four digit decrease with 14,826 discharges in 2012 compared to 10,651 last month.  Louisiana saw the fewest decreases with less than 10.
